The Mental Health Parity and Addiction Equity Act (MHPAEA) requires health plans and insurance companies to provide mental health coverage that is “comparable” to a plan’s medical or surgical coverage. In 2024, mental health parity has risen to the forefront of federal and state regulatory priorities as the nation grapples with mental health issues in the post-COVID era. Significant changes to mental health parity are expected in 2024 and beyond as federal and state authorities move to enforce existing requirements and finalize proposed regulations. At the same time, federal courts continue to respond to a growing number of private lawsuits for alleged violations of MHPAEA regulations.
