D.C. Superior Court Judge Marisa DeMeo ordered a third competency evaluation by the Department of Behavioral Health (DBH) for the defendants accused of participating in the stabbing. The ruling was made during a hearing on June 10.
Steven Herring, 24, is charged with first-degree premeditated murder, being armed and carrying a dangerous weapon outside a home or business, for the stabbing death of Marcus Thurman, 30, in the 100 block of M Street NE on Aug. 22, 2023. Thurman died from his injuries on Sept. 4, 2023.
According to court documents, the defendant and Thurman got into an argument and the defendant stabbed the victim in the chest and then fled the scene on foot.
During the hearing, Judge DeMeo referred to a report conducted by DBH to determine whether Herring was ready to stand trial.
The report states that so far this has not been possible.
“Hospitalization will allow for a more comprehensive assessment and documentation of Mr. Herring’s capabilities and disabilities, which may be difficult to ascertain during a limited interview,” the report said.
Following DBH’s recommendation, Judge DeMeo ordered Herring to undergo a full competency evaluation at St. Elizabeth Hospital’s inpatient facility.
Attorney Joseph Yarbo said he would wait to consider any plea offers from prosecutors until the defendant is found competent by the Plea Commission.
Prosecutors did not object to Yabo’s continued detention.
The party is scheduled to resume on August 9th.
